New Listing Agreements

Attention All Participants
The Commission Escrow Act goes into effect on January 1, 2009. WPMLS has prepared new model Exclusive Right to Sell and Exclusive Agency listing agreements that incorporate in paragraph 12 the language required by the new law, should you choose to use the provisions of the law. The new language is written in such a way that you can also waive your rights under the new law if you so elect. The model listing agreements are available under the Links (& Documents) tab at the top of your Rapattoni MLS screen.
The Commission Escrow Law can be useful in some circumstances to freeze disputed commission payments in place so that you have more time to resolve the dispute with your client. However, there are precise procedures to be followed. WPMLS strongly recommends that before using the provisions of the new law, you review a briefing paper prepared by Mr. Sumber that will walk you through the required steps.
